Faulty Rotary Shifters in Ram 1500’s and Dodge Durangos
Defendants: Fiat Chrysler Automobiles N.V.,
Fiat Chrysler Automobiles US LLC, and
Fiat Chrysler Automobiles Canada Inc.
Summary: Complaints have been made about certain years of Ram 1500 pickup trucks and Dodge Durango SUVs moving while still visibly in the park position, leading to rollaway accidents and serious injuries.
Transport Canada has identified multiple complaints of rollaways in Ram 1500’s and Dodge Durango SUVs. These affected vehicles are alleged shift out of park on their own and without warning. As a result, people have been seriously injured.
According to the complaints, individuals reported leaving their transmissions in park, with the “P” symbol still clearly illuminated after the rollaway incidents. These incidents are alleged to have occurred both when the vehicle is on and off.
The affected models are 2013-2016 Ram 1500 pickups and 2014-2016 Dodge Durangos; both of which feature a rotary-style control to select the gear position, which is electronically linked to the transmission as opposed to physically by a cable and do not have appropriate safety overrides.
The fact that the operator can exit the vehicle when the vehicle is both running and in gear,
without warning, puts the operators at an unreasonable risk.
The U.S. National Highway Traffic Safety Administration (NHTSA) and Transport Canada have both opened investigations into the rotary shifter, but Fiat Chrysler Automobiles has not issued warnings to consumers or recalls for the rotary shifter or corrected the issue.
Some may naturally be reminded of another shifter scandal from Fiat Chrysler Automobiles plaguing their Chrysler 300, Dodge Charger, and Jeep Grand Cherokee vehicles. This issue led to numerous injuries, including the highly-publicized death of actor Anton Yelchin. Guardian Law Group is currently pursuing a Class Action for this matter as well.
Owners of these vehicles should be aware of the potential roll away danger when the vehicles are left in park. It is also advised to always utilize the parking brake in addition to putting the vehicle in park.
